Dear Lawmen: I have my appeal in the 6th circuit. Arnie provided this 6th circuit ruling. I will win my appeal.

One final note. After entering summary judgment and after a notice of appeal had already been filed, the district court granted the IRS's motion to supplement the record on appeal with materials never considered by that court. The IRS now concedes that doing so was improper. Although the materials added to the record on appeal were irrelevant to the disposition of the case, we nonetheless mention the matter in order to comment on the district court's rationale. In its order, the court stated that "since the action is likely to be appealed, and the documents serve to bolster the government's position in this case, this motion is hereby GRANTED." This statement exhibits a certain confusion regarding the proper role of a judge. A central tenet of our republic--a characteristic that separates us from totalitarian regimes throughout the world--is that the government and private citizens resolve disputes on an equal playing field in the courts. When citizens face the government in the federal courts, the job of the judge is to apply the law, not to bolster the government's case. Beaty v. United States, 1991.C06.42163 ¶ 32; 937 F.2d 288 (6th Cir. 1991).

The dismantling of our Republic by the Corporatocracy started around the turn of the 20th century. In 1901, a Justice Harlan warned us of "Legislative Absolutism" (Congress bypassing the Constitution with laws) in a powerful dissent to a Supreme Court ruling. Despite his warning, Absolutism kicked into high gear with passage of the unconstitutional Fed Reserve Act in 1913. That should have been a Constitutional Amendment (which never would have passed, and the bankers knew it)---transferring the regulation of the value of our money from Congress to a group of bankers.

Going off the Gold Standard, going to war without a Declaration of War, virtually trashing the Fourth Amendment, and many other unconstitutional actions have (for all practical purposes) buried the Republic. For the most part, it all happened gradually...and we were not vigilant.

It is so strange to write these words. Where did the country go wrong at? I have my ideas, but what matters the most I suppose is that there are others finally coming out and challenging the government. We few true blue are asking what the hell happened. If my awakening was anything like the many others that are coming around these days...

Where were you when it "hit you?" That the good old US of A; was not so good as we thought it to be? Nor was it old either as it was a whole new beast, monstrous even, from what we were brought up to believe in.

We as a people ask so much from government. But a few ask the government to back off. Those that reach out all the time may mean well enough, but they have no right to ask those in "power?" that are suppose to serve us, each and everyone one of us, not just the majority; have no right to place laws over us that harm no one.

We are suppose to be a republic. Something most have seem to have forgotten.

The horror that is now Iraq. Who is that for? Many in "our" government are telling us that we need to be there. More and more are starting to speak out against it. Some even announcing that we should never have been there in the first place.

Has anybody noticed the impotence of the authorities to swiftly carry out the execution of the Unlawful Court Conviction of Ed and Elaine Brown? Should not that be telling the American Public something about the quality of their present justice system?

For those who have been through the legal process, there is no mystery to the delay in federal law enforcement's carrying out the order of the court. It is because they are skating on thin ice in their unlawful rule, and more and more Americans are waking up to their game.

The courts have their hands full with the people who are awakening to their True status as Living, Breathing, Flesh-and-Blood, Sentient, Natural men and women -- Sovereign Sons and Daughters of God who now refuse to waive their rights or contract, consent, or grant jurisdiction to the FICTIONAL court. Without such, the FICTION Courts have no power to carry out the policies of Mammon.

In my own personal case, when I began to hold my Josephine County, Oregon public
officials, Judges, DA's and Sheriff personally responsible for their unlawful conspiracy to cover up actions in their agent's kidnapping, armed robbery, and holding this Living, Breathing, Flesh-and Blood, Sentient, Natural man hostage on the pretext of a traffic infraction -- itself, not a jailable offense (but nevertheless
it didn't prevent them from taking me at gunpoint), they knew they had a problem on their hands when I set out to seek remedy for their actions by using their own UCC lien process.

Their immunitity of public office could not protect them privately via the UCC liens, so Josephine County, Oregon District Attorney CLAY E. JOHNSON resorted to government CYA (Cover Your Ass) tactics and conjured up a secret Grand Jury Indictment and sat on it for 6 months waiting to see whether I would go beyond the personal UCC filings of the Individuals and file the lien against the STATE OF OREGON and COUNTY OF OSEPHINE..

When I filed the lien, they arrested me for being a "Paper Terrorist" under the Patriot Act; i.e., "Simulation of Legal Process" (the filing of the liens). After all, how could government possibly continue to carry on their business of raping, robbing, and holding folks Hostage for Ransom if they were going to be held responsible for their actions? I am sad to report that I am the latest member of the Tax honesty Movement to fall victim to the unlawful enforcement actions of the Internal Revenue Service, and the insensitive and

sometimes despicable actions of the judicial branch (DOJ) acting without jurisdiction, and end up locked in a cage.

I write this letter from the Federal Detention Center in Philadelphia, right across the street from the federal courthouse, where ten days ago, after having concluded my allocation (meaning “plea for mercy”) I heard the judge remind me that the federal income tax system is one of voluntary compliance before telling me he was hitting me with the maximum time amount suggested by the guidelines for not , supposedly, volunteering. You heard that right! Recall that in its brief back in the interlocutory appeal phase the government and said therein that if the idea that an assessment is a prerequisite to any possible evasion of payment charge is allowed to stand, it would have a crippling effect on the nation’s voluntary compliance tax system. Here in court, two months later, I stood and heard a federal judge admit again that it’s a voluntary system as he sent me to jail.

now i cannot remember for certain, but i know that i said it some where that i was impressed with how many people call Ed and Elaine everyday, and not the same ones either. every time he answers and talks to people, everyday folk.

some are well wishers, some are prayers, some are thank yous, and a lot of them are asking for help. and help he does. i have not been able to listen to every call that comes in but i have been able to hear a few of the stories when given the ok by the callers.

all sorts of issues are brought up. but today, one caller stood out. ed stopped eating supper to listen to the woman walking into another room. elaine and i finished eating and cleaned up and talked to others.

when ed was done, he walked in straight to me and told me that i had to help him. that i had to help him help this woman. he wanted her story to get out so she can get more help to her.

ed asked if i could get someone to call her to be able to help her. i told him i could before i wrote up the blog. ed helped me get to her site.

i decided i should read the site so i would not ask any stupid questions when i spoke with her later. (link will be at the bottom.)

it was a long and hard read. three years going on four and still the her site is not fully updated.

talking to her was even harder. she broke down crying three times. she slowed down in her speaking as she told me her story more times then i can remember.

then in classic fashion for me here, my phone went dead. i tried to call back but never got through. that was upsetting but i had heard more then enough.

THIS IMAGE FROM JPFO HAS HAUNTED ME since I first saw it several weeks ago. For one thing, it's just a great graphic. But also, a great idea.

Why do 100 million (or 80 million, or 50 million, or whatever) gun owners allow themselves to be terrorized by such a small band of thugs? (2300 is the number of ATF employees dedicated to infringing on the Second Amendment.) I'm sure if you asked around the answers would range anywhere from simple ignorance, arrogance, or apathy ("They'll never come for my trap gun") to terror ("Yeah, but those 2300 have the whole fedgov behind them" or "Yeah, but when even a dozen of those bastards come after you, you're outnumbered").

In either case, the ATF -- and the whole brutal, unconstitutional, control-freaking federal government wins while we lose. Just because we don't exercise our own obvious power. If a mere one percent of gun owners said, "No more!" the entire ATF could be exiled to the North Pole, where global warming could eventually send them down below where they belong.

But we can't gather our strength.

Dear Mr. Monier,

You have stated in the news paper, that the Browns are a public safety problem. Due to allege threats against federal personnel.

I Edward Lewis family Brown, have never threatened anyone in my life.

It is unlawful to threaten, however, I have warned everyone and anyone that has ever threatened me; that if they attempt to do so or will do so, I will follow the letter of the law (note criminal law, LETHAL FORCE DOCTRINE), that I will use equal or greater force as the law dictates in order to protect myself, my property, my family, my community, my county, my state and my nation at any cost.

If you feel that following the letter of the law would endanger public safety, then perhaps you should review your U.S. Marshals rules of engagement and consider who actually is conducting the danger to public safety.

It seems ever increasing that the many law enforcement agencies are creating the dehumanizing hazards to public safety. We will always remember that all government personnel are either law enforcement agents or revenue gathers. Their primary function is currently to protect their own positions, (jobs), for their own personal enrichment, that is why we always hear them say, "I'm just doing my job." It saddens me that you do not seem to understand the the higher law of man and god and elect instead to enter the snake pit.

In today’s show, I thought Elaine Brown very adequately equated civil disobedience, to spiritual obedience. You see, she pointed out the fact that many of man’s laws are in conflict with gods laws, and that in the end we must choose whom we are a subject too. Are we a subject to man, or subject to God? Can we serve two masters, when they come into conflict with one another?

One thing that I would like to add to that is the way organized religions misinterpret the scriptures with respects to paying Caesars things to Caesar, and God’s things to God. Carl Drega (?1930–August 19, 1997) was a man from Columbia, New Hampshire, who killed 2 state troopers, a judge and a newspaper editor and wounded three other law enforcement officers before being shot to death in a firefight with police. The book The Ballad of Carl Drega by Vin Suprynowicz is named for him.

Dear Mr. and Mrs. Brown:

Proceedings in the U.S. District Court have now concluded. You have been convicted of felony offenses against the United States, and have now been sentenced to a period of confinement in the United States Bureau of Prisons. This is now a matter for the U.S. Marshals Service and their law enforcement partners.

As you both know, there are outstanding warrants for your arrests. To date, you have made statements threatening law enforcement if attempts are made to serve those warrants. This creates a public safety concern for the community and subjects both you, and anyone who may be assisting you with this obstruction of justice, to further prosecution.

Until they are served, these warrants are not going away, and neither is law enforcement. The United States Marshals Service has maintained an open line of communication with both of you. We have, and will continue to take, all reasonable steps to resolve this peacefully. But, in order to remedy the situation you have placed yourselves in, without subjecting yourselves to further liability, here is what you need to do:

1. Contact us to make arrangements, and

2. Surrender peacefully to the United States Marshals Service.

You have my assurance that you will be treated professionally, with courtesy and respect. This is the right thing for you to do, and I encourage you to do it.

Amazing Grace: An Open Letter To Supporters of Ed and Elaine Brown

Dear Friends:

Today is the beginning of the 105th day from/including January 11th when Ed and Elaine made their decision to not go back to court. January 11th happened to also be the 146th anniversary of Alabama's "Ordinance Of Secession" in 1861. When Alabama and the other southern states seceded they all knew there was the potential for war, but from a moral standpoint the sovereign individuals who ruled those states knew that, under God, they really had no choice.

As one internet columnist wrote: "Southerners thought the government was becoming too strong. They did not think the government had the right to tell them how they should live. Southerners felt if they stayed in the United States, the North would control them."

To continue, "Some southern states decided they had no choice. They decided to secede, or leave, the United States. South Carolina was the first to leave the Union and form a new nation called the Confederate States of America. Four months later, six other states seceded. They were Georgia, Florida, Alabama, Mississippi, Texas and Louisiana. Later Virginia, Arkansas, North Carolina, and Tennessee joined them. The people of these states elected Jefferson Davis as president of the Confederacy."

Ed and Elaine Brown are "A Beacon Of Hope And Faith For Mankind". They are a lighthouse that's being buffeted from all quarters by a raging sea of evil just like Morris Island Lighthouse by the harbor in Charleston South Carolina is being threatened by the forces of the wind, weather and sea. But there is hope!

I would like to invite,and urge everyone to continue to pray for Ed and Elaine Brown throughout today and everyday from this day forward. We The People need to realize that there are massive forces for goodness and truth in the universe. Morris Island Lighthouse - like Ed and Elaine - may be threatened, but there are people there who are rallying to "Save The Light!" Let's be sure to continue to "rally around the flagpole of freedom" so that We The People of America can "Save The Light" of our Lord God and Saviour, Jesus Christ, The King!

Before I close I would like to leave this little example of another ray of divine hope and light as follows:

Before I dropped my little 5 year old son, Andrew, off at St. Joseph pre-school in Wilmette Illinois this morning he handed me this letter he received last week from his teachers which he urged me to be sure to give to my wife, his mother, which read:

"Dear Parents:

The children seem very happy to be back at school. It seems as though they picked up where they left off! We hope that you had a wonderful Easter!

Religion: the Last Supper is an activity where there are small figurines which represent Jesus and his twelve disciples. A table with a tablecloth, candles and candlesticks, a chalice and a paten with a host. The Gospel is read as the child moves the figures. We discussed what this gathering meant. Jesus knew that the bad men were going to nail him to the cross but He also knew that God was stronger than that as He was raised up to Heaven that Easter morning. He promised us that His light would never go out again. The bad guys did not win, Jesus did!"

The letter was dated April 20, 2007 was the 118th anniversary of the birth of Adolph Hitler and it was the one (1) year anniversary of an incident that my two younger boys witnessed, to their and my/their horror, in Campbellsport WI last year. A friend of mine and myself were arrested and handcuffed for no cause while we were trying to deliver food and good cheer to another individual/friend who was being stalked and terrorized by his local county sheriff's dept. My two sons witnessed this horror in the light of an incredibly beautiful day. Tears were streaming down their eyes as they cried and cried while I was locked up in the back of one of three sheriff's cars. Without any provocation on my part or the part of my friend, two of the sheriffs forcibly restrained me and threatened to mace me while I was arrested and handcuffed without being charged of any crime. My friend was next. We were being used as hostages by the sheriff's dept. to get my friend to come out of his house which he did peacefully and they attacked, subdued, arrested and handcuffed him, too.

It took some time, but they finally released my friend and me. I guess they knew they had overstepped - by a very wide margin - their authority and my friend and I were very peaceful, yet very irritated and concerned nonetheless. I was more worried about my two sons, Andrew and Thomas - 4 and 8 years at the time. They were not offered any assistance of any kind by the officers. They ended up retreating to the only place of safety they knew which was our van/car.

Here we are one year and 5 days later. Deep in the subconscious areas of my two sons mind is the memory of that event. I will never, ever, forget. But looking back, my friend - who we bailed out of jail a few hours later - has been left alone and he has repeatedly said to me/us that if we had not visited him on that day he instinctively feared/knew that he could have been shot to death as part of some hidden agenda these folks seem to be part of in our world.


I would like to leave everyone with another message about the power of "Amazing Grace" the movie which was released on 2/23 of this year on the 200th anniversary of the vote by British Parliament to end the slave trade. My wife and I saw this movie, Amazing Grace, this past Saturday and it so deeply moved me that tears streamed down my face at the incredible power of divine wonder and joy that came with reliving the powerful story of the mission of one solitary individual, William Wilberforce (24 August 1759 – 29 July 1833) a British politician, philanthropist, and abolitionist who led the parliamentary campaign against the slave trade in the British Empire.


In honor of Ed and Elaine Brown, William Wilberforce and this "Amazing Grace" of Divine energy, light and love that continues to bless us I would like to sing this special song while we're on the "Ed and Elaine Brown Show" on Republicbroadcasting.org later today from 2-3 pm Eastern time. But Browns say they will not be in court

Ed and Elaine Brown could face more than seven and six years in prison each if the judge agrees with prosecutors' recommendations at the couple's sentencing hearings today in federal court.

The Browns were convicted in January of conspiring to defraud the government, conspiring to disguise large financial transactions and disguising large financial transactions to avoid reporting requirements. Elaine Brown, whose West Lebanon dental practice generated the couple's income, was also convicted of multiple counts of tax evasion and failure to withhold employment taxes.

At trial, the couple admitted that they did not pay any income taxes for more than 10 years, but they claimed that there was no law that made them liable for the taxes.

Continuing his discussion on this topic, Mr. Choate expressed himself as being quite willing to leave the decision of the Panama Canal in the hands of the British and American pilgrims, which anyone can readily understand would be a one-sided decision; i.e., all for England and nothing for the United States.

"Now the people of this country are not going to allow anybody any Congress, any government, any President - to bread the good faith which they have pledged to the mother county."

In making this statement, Mr. Choate takes the position that Great Britain or Eengland is our mother country; the same position that was taken by Cecil Rhodes over 50 years ago and by Andrew Carnegie in 1893, when he wrote a book entitled, "Triumphant Democracy."

I want you to note particularly that this was in 1913, and that 1913 was the very year we changed our Government from a republic to a semidemocracy; the year in which we destroyed constitutional government, international security, and paved the road for us to become a colony of the British Empire. It was also the same year in which we, by adopting the Federal Reserve Act, placed our Treasury under the control and domination of the Bank of England and the international banking groups that are now financing the British-Israel movement in the United States. It was also the year preceding the World War; a war in which we became involved, as everyone knows, in 1917, but what everyone does not know is that we were committed to this war in 1910, and were to all intents and purposes in the war in 1914, when J. P. Morgan & Co. began to finance the Triple Entente. This statement is borne out by Mr. J. P. Morgan's own testomony before the Senate committee investigating the munitions industry.

Mr. Choate was, therefore, right, because nothing has stopped, not even Congress, the destruction of this Republic and its gradual incorporation into the British Empire through the efforts of the many subversive and pro_English groups, led and directed, as I have said, by the British-Israel movement.

Dave Ridley again tells Federal Judge in Court that he will not pay fine

Judge Muirhead asked Dave Ridley to appear in Federal Court Monday to explain why he had not yet paid a $125 fine. Washington had charge Ridley with "Distribution of Handbills" after he handed anti-torture flyers to IRS workers last year. The Keene resident came as requested along with an anti-IRS sign, some notes regarding the constitution, and more than a dozen supporters.

look the whole thing about the protest or what ever this was, is this, nearly no one knew about it. though we were able to even pick up an extra person while out there, the planing was crappy plain and simple. on saturday when i met the first group of people i thought they were the ones going to do this protest, just to find out later that a few of them only were going to come along. i think one said they wanted to go but they were going to climb a mountain instead. ?

i am not judging just trying to explain how the events came about. ed, elaine and myself barely knew what was going on, and even those that were setting it up seemed to be reaching past their grasp.
