Paul Ballmer v Cal FTB Trial

The trial for Ballmer v FTB is scheduled to start on Monday, Feb. 26th at 1:30 pm in Dept 41, Judge Sohijian presiding, at the Los Angeles County Courthouse, 111 N. Hill St, Los Angeles. At the trial, both the legal and factual issues relating to the FTB's violations of the Information Practices Act, California Civil Code, Sec 1798 et seq. (IPA) will be litigated. We will be seeking an injunction against the FTB prohibiting further violations of the IPA. The trial is expected to last about 3 days. The Bates et al v FTB trial, is not currently scheduled, but the trial is expected to be sometime in March or April, 2007. It has been agreed between all parties that the Ballmer trial will decide the legal issues for both cases. Thus, the Bates trial will decide only the factual issues for the 5 plaintiffs in Bates case. Note: The Ballmer and Bates cases were both filed Dec. 31, 2002.
